Privacy and Security Policy

Direct-Choice Pty Ltd ACN 114 225 188 (Direct-Choice) respects and upholds your rights to privacy protection under the National Privacy Principles contained in the Privacy Act 1988 (Cth) and any similar legislation applicable to Direct-Choice's business. The National Privacy Principles can be found at www.privacy.gov.au

This policy describes how Direct-Choice manages any personal information it has about you.

By visiting Direct-Choice's website (http://www.direct-choice.com/) or any other Direct-Choice related website (referred to collectively as the Direct-Choice Network), you are accepting the practices described in this privacy policy.


Information collection

1. As a user of the Direct-Choice Network, you may be asked to submit personal information to Direct-Choice. The information that Direct-Choice holds about you may include, but is not limited to, your name, email address, home address and contact telephone number.

2. If at any time you provide the personal information of another person to Direct-Choice, you must ensure that the other person has read and understood this policy and separately consents to that personal information being used and disclosed by Direct-Choice in accordance with this policy. It is your responsibility to ensure that you have obtained all necessary consents to the disclosure of the personal information of another person to Direct-Choice. Direct-Choice expressly excludes, to the maximum extent permitted by law, all liability for loss or damage of any kind (including but not limited to indirect and consequential loss) arising from or relating in any way to your failure to obtain such consents.

3. Direct-Choice may also collect the following information from the Direct-Choice Network:

(a) Statistical information

Direct-Choice may collect statistical information regarding the use of the Direct-Choice Network. This collection includes your computer's Internet Protocol (IP) address, the date and time of your visit, previous sites visited and browser type. This information is collected to provide Direct-Choice with information about the use of the Direct-Choice Network, and to help Direct-Choice maintain and develop the Direct-Choice Network to provide better information to users.

(b) Cookies

Direct-Choice's Network sometimes uses cookies and log files. These involve the collection of personal information about you, including your habits when accessing the Direct-Choice Network and any information you provide in customising the Direct-Choice Network.

You can prevent this collection of information by setting your browser from accepting cookies. This will not prevent you from accessing the Direct-Choice Network, however it may prevent you from utilising all features of the Direct-Choice Network.


Use and disclosure of information

4. The information Direct-Choice collects may be used:

(a) to process your purchase orders with third party suppliers of product and services on the Direct-Choice Network, and to provide receipts;

(b) to confirm your identity when you make enquiries about your purchase;

(c) to improve the quality of our services to you (eg: to tailor our services to suit a particular demographic);

(d) to communicate with you about work that Direct-Choice is undertaking;

(e) to respond to your queries;

(f) to republish information on the Direct-Choice Network;

(g) to send you our newsletters, and information about special offers and promotions ;

(h) for Direct-Choice's internal business, administrative, marketing, planning, and research requirements;

(i) for purposes that are expressly permitted under any agreement with you; and

(j) to do any of those things listed in sections 4(a) to 4(i) (inclusive) through the Direct-Choice Network and in conjunction with or through Direct-Choice's subsidiary companies.

5. Direct-Choice will not use or disclose, and will use reasonable endeavours to prevent the use or disclosure of, information provided by you except:

(a) as required for performance by Direct-Choice of services for, or delivery of products to, you;

(b) expressly permitted under any agreement with you;

(c) on a confidential basis to agents that Direct-Choice uses in the ordinary operation of its business, such as for data processing, printing or mailing;

(d) on a secured basis as required for the ordinary operation of the Direct-Choice Network, such as sending the information to a back up data centre;

(e) as required under compulsion of law or provided in co-operation with any governmental authority; or

(f) where it is already publicly available or is disclosed by Direct-Choice in a manner that does not readily permit identification of information relating to you.


Access and Correction

6. You may request access to personal information about you held by Direct-Choice by writing to Direct-Choice's Privacy Officer at the address below. Where Direct-Choice holds information that you are entitled to access, Direct-Choice will endeavour to provide you with a suitable range of choices as to how you access it (e.g. emailing or mailing it to you).

7. If you believe that personal information Direct-Choice holds about you is incorrect, incomplete or inaccurate, then you may correct that information yourself by updating your details on your Direct-Choice account (if you have such an account), or request that we amend that information for you. Direct-Choice will consider if the information requires amendment. If Direct-Choice does not agree that there are grounds for amendment, then Direct-Choice will add a note to the personal information stating that you disagree with it.

8. Direct-Choice may impose a small administrative fee to correct any personal information about you that is held by us. We will advise what that fee is prior to undertaking any correction.


Marketing and promotion communications

9. Direct-Choice may use the personal information provided to send newsletters outlining news, services, promotional offers or events (both electronic and hardcopy) to you.

10. You may opt out of receiving any communications from Direct-Choice at any time (other than as required for the operation of our business, e.g. information about your request for a refund). If you wish to do this, please do so by written request addressed to our Privacy Officer at the address below. Please indicate on your request whether you wish to opt out of either, or both, postal and electronic marketing communications.


Security

11. Although Direct-Choice has implemented a number of security measures to protect the security and integrity of the information that you have provided to Direct-Choice via the Direct-Choice Network, the Direct-Choice Network is linked to the Internet which is inherently insecure. Accordingly, Direct-Choice cannot provide any definitive assurance regarding security of the information. So while Direct-Choice strives to protect such information, Direct-Choice cannot ensure or warrant the security of any information you transmit to Direct-Choice and you do so at your own risk. Direct-Choice will not be liable in any way in relation to any breach of security or unintended loss or disclosure of information due to the Direct-Choice Network being linked to the internet.

12. Similarly, Direct-Choice accepts no responsibility for unauthorised use of passwords, user ID's or any other security mechanism provided to you (if any), other than unauthorised use by Direct-Choice's own staff.

13. Once the information is collected, Direct-Choice will take all reasonable steps to protect that information from misuse, loss or unauthorised access. Direct-Choice will cease using and where it is able to do so, destroy, your personal information once it is no longer needed for the purpose for which the information was collected.


Links to other websites

14. Direct-Choice's Network may contain links to other websites. Direct-Choice is not responsible for the privacy practices or the content of those websites.

15. Direct-Choice expressly excludes, to the maximum extent permitted by law, all liability for loss or damage of any kind (including but not limited to indirect and consequential loss) arising from or relating in any way to your disclosure of personal information about you or any other person to third parties or websites operated by third parties.


Miscellaneous

16. This policy represents Direct-Choice's policy as at [1 April 2011]. Direct-Choice may change this privacy policy from time to time. Any amendment will be made on a prospective basis, i.e. all information received or retained before the time of any amendment will remain subject to the privacy policy applicable before the amendment.

17. Although Direct-Choice intends to observe this policy at all times, it is not legally binding on Direct-Choice in any way. From time to time Direct-Choice may regard it as necessary or desirable to act outside this policy. Direct-Choice may do so subject to any statutory rights you have under the Privacy Act or other applicable legislation.
